These Terms of Service ("Terms") govern your use of the HEAR+ASK platform (the "Service"), operated by Nordex Technologies Inc. ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.
1. Acceptance of terms
By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Description of service
HEAR+ASK provides a private customer intelligence platform that includes:
- Private feedback collection via QR codes and direct links.
- Demand validation campaigns to test ideas before investment.
- Targeted surveys delivered via email or WhatsApp.
- Customer management and segmentation tools.
- AI-powered analytics and insights.
3. Account registration and responsibilities
You must provide accurate and complete information when creating an account. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized access.
4. Subscription and billing
The Service is offered on a monthly or annual subscription basis, billed through Stripe. Subscription fees are charged in advance and are non-refundable except where required by law. You may cancel your subscription at any time; access continues until the end of the current billing period.
5. Free trial
New accounts include a 14-day free trial. No credit card is required to start the trial. At the end of the trial period, you may convert to a paid subscription or the account will be deactivated.
6. Acceptable use
You agree not to:
- Use the Service to send spam or unsolicited communications.
- Submit fraudulent, fabricated, or manipulated feedback or survey data.
- Attempt to reverse engineer, exploit, or otherwise abuse the platform.
- Use the Service for any unlawful purpose or in violation of any applicable regulation.
7. Data ownership
You retain full ownership of all data you and your customers submit to the Service. HEAR+ASK acts as a data processor on your behalf, not as an owner of your data. You may export or delete your data at any time.
8. Limitation of liability
The Service is provided "as is" and "as available," without warranties of any kind, express or implied. To the maximum extent permitted by law, Nordex Technologies Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
9. Termination
We reserve the right to suspend or terminate accounts that violate these Terms, abuse the platform, or pose a risk to other users. You may terminate your account at any time from your account settings.
10. Governing law
These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to its conflict of laws principles. Any disputes shall be resolved in the courts of British Columbia.
